The job

The EU packaging regulation has applied since 12 August 2026, with no national transposition and no size exemption. Three obligations land on day one: a declaration of conformity per packaging type, backed by a technical file; substance restrictions, including the ban on PFAS in food contact; and registration with the extended producer responsibility scheme in every member state where you sell. Producer and importer marking becomes mandatory, and online selling adds the empty-space rule. A market surveillance authority can hold a shipment and ask for the documentation within ten days. That is the deadline that hurts when no file exists. A lab produces those documents from your pasted specifications.

We are six people. Is there no small-business exemption?

No. That is the peculiarity of this text and the reason it catches so many people out: it applies per type of packaging placed on the market, not per company size. A six-person brand owes the same declaration of conformity as a group, on every one of its packaging references.

My packaging supplier says they handle it.

Ask them to put it in writing, and look at what capacity they are acting in. Whoever places the packaging on the market under their own brand is not always whoever made it, and the declaration follows the obligation, not the purchase order. That is precisely the lab's first question: who is producer and who is importer on this reference.

What does an inspection actually look like?

Like a held shipment and a request for documentation within ten days. Ten days is short to write a technical file from nothing and plenty to fetch one already written. The whole difference sits there.

Do PFAS concern me if I sell cosmetics?

The ban in question covers food contact. The heavy metal limits do not stop at food. The lab does not guess your composition: it tells you which questions to put to your supplier, reference by reference, and flags the answers that are not answers.

And after 2026, is that it?

No, and that is why a living file beats a one-off document. Harmonised marking arrives in 2028, reuse and recyclability in 2030. Every new packaging reference reopens the same work. A maintained file gets updated; a PDF written in a panic gets rewritten.
